  • Debts Recovery Tribunal

    Keeping in line with the international trends on helping financial institutions recover their bad debts quickly and efficiently, the Government of India has constituted thirty three Debts Recovery Tribunals and five Debts Recovery Appellate Tribunals across the country.

    The Debts Recovery Tribunal (DRT) enforces provisions of the Recovery of Debts Due to Banks and Financial Institutions (RDDBFI) Act, 1993 and also Securitization and Reconstruction of Financial Assets and Enforcement of Security Interests (SARFAESI) Act, 2002.

    Under the Recovery of Debts Due to Banks and Financial Institutions (RDDBFI) Act, 1993 banks approach the Debts Recovery Tribunal (DRT) whereas, under Securitization and Reconstruction of Financial Assets and Enforcement of Security Interests (SARFAESI) Act, 2002 borrowers, guarantors, and other any other person aggrieved by any action of the bank can approach the Debts Recovery Tribunal (DRT).

    Debts Recovery Tribunal are located across the country. Some cities have more than one Debts Recovery Tribunals. New Delhi, Chennai, Kolkata and Mumbai have three Debts Recovery Tribunals. Ahmedabad and Chandigarh have two Debts Recovery Tribunal (DRT) each. One Debts Recovery Tribunal has been constituted at Allahabad, Aurangabad, Bangalore, Coimbatore, Cuttack, Earnakulam, Guwahati, Hyderabad, Jabalpur, Jaipur, Lucknow, Madurai,Nagpur, Patna, Pune, Vishakapatnam and Ranchi.

    Appeals against orders passed by Debts Recovery Tribunal (DRT) lie before Debts Recovery Appellate Tribunal (DRAT). There five Debts Recovery Appellate Tribunal (DRATs) located in the country. One Debts Recovery Appellate Tribunal (DRAT) is located each at Delhi, Allahabad, Mumbai, Chennai and Kolkatta. A Debts Recovery Appellate Tribunal (DRAT) conducts circuit sittings in different cities where Debts Recovery Tribunal (DRTs) are located over which it has appellate jurisdiction.

    There are a number of States that do not have a Debts Recovery Tribunal. The Banks & Financial Institutions and other parties in these States have to go to Debts Recovery Tribunal located in other states having jurisdiction over there area. Thus the territorial jurisdiction of some Debts Recovery Tribunal is very vast. For example, the Debts Recovery Tribunal located in Guwahati has jurisdiction over all the seven North Eastern States. Similarly, the territorial jurisdiction of the Debts Recovery Tribunal-2 Chandhigarh too has a very wide jurisdiction over the States of Punjab, Himachal and Harayana, Chandhigarh.

    The setting up of a Debts Recovery Tribunal is dependent upon the volume of cases. Higher the number of cases within a territorial area, more Debts Recovery Tribunal would be set up.

    Each Debts Recovery Tribunal (DRT) is presided over by a Presiding Officer. The Presiding Officer is generally equavalent to the rank of Dist. & Sessions Judge. A Presiding Officer of a Debts Recovery Tribunal is assisted by a number of officers of other ranks, but none of them need necessarily have a judicial background. Therefore, the Presiding Officer of a Debts Recovery Tribunal is the sole judicial authority to hear and pass any judicial order.

    Each Debts Recovery Tribunal has two Recovery Officers. The work amongst the Recovery Officers of a Debts Recovery Tribunal (DRT) is allocated by the Presiding Officer of the Tribunal. Though the Recovery Officer of the Tribunal need not be a judicial Officer, but the orders passed by a Recovery Officer are judicial in nature, and are appealable before the Presiding Officer of the Debts Recovery Tribunal (DRT).

    The Debts Recovery Tribunal are governed by provisions of the Recovery of Debts Due to Banks and Financial Institutions Act, 1993, also popularly called as the RDDBFI Act. Rules have been framed and notified under the Recovery of Debts Due to Banks and Financial Institutions Act, 1993.

    After the enactment of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interests (SARFAESI) Act any aggrieved person can approach a Debts Recovery Tribunal (DRT). Earlier only Banks were entitled to approach the Debts Recovery Tribunal (DRT).

    The Debts Recovery Tribunal (DRT) are fully empowered to pass comprehensive orders and can travel beyond the Civil procedure Code to render complete justice. A Debts Recovery Tribunal (DRT) can hear cross suits, counter claims and allow set offs. However, a Debts Recovery Tribunal (DRT) cannot hear claims of damages or deficiency of services or breach of contract or criminal negligence on the part of the lenders. In addition, a Debts Recovery Tribunal (DRT) cannot express an opinion beyond its domain, or the list pending before it.

    The Debts Recovery Tribunal can appoint Receivers, Commissioners, pass ex-parte orders, ad-interim orders, interim orders apart from powers to Review its own decisions and hear appeals against orders passed by the Recovery Officers of the Tribunal.

    The recording of evidence by Debts Recovery Tribunal is somewhat unique. All evidences are taken by way of an affidavit. Cross examinations is allowed only on request by the defense, and that too if the Debts Recovery Tribunal (DRT) feels that such a cross examinations is in the interest of justice. Frivolous cross examination are denied is the same can be brought on record by way of affidavit. There are a number of other unique features in the proceedings before the Debts Recovery Tribunal all aimed at expediting the proceedings.


    Debts Recovery Appellate Tribunal Allahabad:- The territorial jusrisdiction of the Hon`ble Tribunal covers Over Debts Recovery Tribunal Allahabad, Debts Recovery Tribunal Lucknow and Debts Recovery Tribunal Jabalpur.

    Debts Recovery Appellate Tribunal Chennai:- The territorial jusrisdiction of the Hon`ble Tribunal covers Over Debts Recovery Tribunal Bangalore, Debts Recovery Tribunal Chennai-1, Debts Recovery Tribunal Chennai-2, Debts Recovery Tribunal chennai-3, Debts Recovery Tribunal Coimbatore, Debts Recovery Tribunal Hyderabad, Debts Recovery Tribunal Vishakapatnam, Debts Recovery Tribunal Ernakulam and Debts Recovery Tribunal Madurai.

    Debts Recovery Appellate Tribunal Delhi:- The territorial jusrisdiction of the Hon`ble Tribunal covers Over Debts Recovery Tribunal Chandhigarh, Debts Recovery Tribunal Delhi-1, Debts Recovery Tribunal Delhi-2, Debts Recovery Tribunal Delhi-3, and Debts Recovery Tribunal Jaipur.

    Debts Recovery Appellate Tribunal Kolkata:- The territorial jusrisdiction of the Hon`ble Tribunal covers Over Debts Recovery Tribunal Cuttak, Debts Recovery Tribunal Guwahati, Debts Recovery Tribunal Patna, Debts Recovery Tribunal Kolkata-1, Debts Recovery Tribunal Kolkata-2, Debts Recovery Tribunal Kolkata-3, and Debts Recovery Tribunal Ranchi.

    Debts Recovery Appellate Tribunal Mumbai:- The territorial jusrisdiction of the Hon`ble Tribunal covers over Debts Recovery Tribunal Ahmedabad, Debts Recovery Tribunal Aurangabad, Debts Recovery Tribunal Mumbai-1, Debts Recovery Tribunal Mumbai-2, Debts Recovery Tribunal Mumbai-3, Debts Recovery Tribunal Nagpur and Debts Recovery Tribunal Pune.


    Debts Recovery Tribunal - 1 Ahmedabad:- The territorial jusrisdiction of the Hon`ble Tribunal covers State of Gujarat and Union Territories of Dadra & Nagar Haveli, Daman & Diu.

    Debts Recovery Tribunal - 2 Ahmedabad:- The DRT-2 Ahmedabad has been constituted by the Central Government.

    Debts Recovery Tribunal Allahabad:- The territorial jusrisdiction of the Hon`ble Tribunal covers Allahabad, Auraiya, Azamgarh, Ballia, Banda, Basti, Budan, Chandauli, Chitrakut, Deoria, Etah, Etawah, Farrukahabad, Fatehpur, Firozabad, Ghazipur, Gorakhpur, Hamirpur, Jalaun, Jaunpur, Jhansi, Kanauj, Kanpur (Rural), Kanpur (Urban), Kaushambi, Kushinagar, Lalitpur, Haharajganj, Mahoba, Mainpuri, Mau, Mirzapur, Sant Kabir Nagar, Sant Ravi Das Nagar, Sidharthnagar, Sonbhadra, Varnasi districts of Uttar Pradesh & any other area in State of Uttar Pradesh not covered within the jurisdiction of DRTs at Lucknow & Allahabad.

    Debts Recovery Tribunal Aurangabad:- The territorial jusrisdiction of the Hon`ble Tribunal covers Aurangabad, Nanded, Jalna, Beed, Parbhani, Hingoli, Dharashiv, Latur, Ahmadnagar, Jalgaon, Dhule, Nandurbar and Nashik districts of Maharashtra state.

    Debts Recovery Tribunal Bangalore:- The territorial jusrisdiction of the Hon`ble Tribunal covers State of Karnataka.

    Debts Recovery Tribunal-1 Chandhigarh:- The territorial jusrisdiction of the Hon`ble Tribunal covers Himachal Pradesh, Punjab, Haryana and Chandigarh.

    Debts Recovery Tribunal - 1 Chennai:- The territorial jusrisdiction of the Hon`ble Tribunal covers Area under Egmore-Nungambakkam and Mylapore-Triplicane Taluk limits of Chennai and Union Territory of Pondicherry.

    Debts Recovery Tribunal - 2 Chennai:- The territorial jusrisdiction of the Hon`ble Tribunal covers Areas Under Tondiarpet and Mambalam - Guindy Taluk limits of Chennai.

    Debts Recovery Tribunal - 3 Chennai:- The territorial jusrisdiction of the Hon`ble Tribunal covers Areas under Perambur-Purasawalkam Taluk limits of Chennai and Districts of Kanchipuram, Tiruvallur, Vellore, Villupuram, Cuddalore, Tiruvannamali, Pudukottai, Thanjavur, Thiruvarur, Nagapattinam, Perambulur and Charmapuri in the State of Tamil Nadu.

    Debts Recovery Tribunal Coimbatore:- The territorial jusrisdiction of the Hon`ble Tribunal covers Districts of Coimbatore and Nilgiris in the State of Tamil Nadu.

    Debts Recovery Tribunal Cuttak:- The territorial jusrisdiction of the Hon`ble Tribunal covers State of Orissa.

    Debts Recovery Tribunal Ernakulam:- The territorial jusrisdiction of the Hon`ble Tribunal covers State of Kerala & Lakshadweep.

    Debts Recovery Tribunal Guwahati:- The territorial jusrisdiction of the Hon`ble Tribunal covers Assam and other North Eastern States and Sikkim.

    Debts Recovery Tribunal Hyderabad:- The territorial jusrisdiction of the Hon`ble Tribunal covers Adilabad, Anantapur, Chittoor, Cuddapah, Hyderabad, Kurnool, Khammam, Karim Nagar, Mehbubnagar, Medak, Nalgonda, Nizamabad, Rangareddi, & Warangal districts of Andhra Pradesh and remaining areas of Andhra Pradesh not covered in the jurisdiction of DRT Vishakhapatnam.

    Debts Recovery Tribunal Jabalpur:- The territorial jusrisdiction of the Hon`ble Tribunal covers States of Madhya Pradesh and Chhattisgarh.

    Debts Recovery Tribunal Jaipur:- The territorial jusrisdiction of the Hon`ble Tribunal covers State of Rajasthan.

    Debts Recovery Tribunal-1 Kolkata:- The territorial jusrisdiction of the Hon`ble Tribunal covers Kolkata city covering the areas of the following police station:-Hare Street, Park Street, Shakespeare Sarani, Bowbazar, Muchipara, Taltolla, Hastings, North Port.

    Debts Recovery Tribunal-2 Kolkata:- The territorial jusrisdiction of the Hon`ble Tribunal covers Al districts of West Bengal (except Kolkata City) and Andaman & Nicobar Islands

    Debts Recovery Tribunal-3 Kolkata:- The territorial jusrisdiction of the Hon`ble Tribunal covers Kolkata City covering the areas of the following police station:- Shyampukur, Jorabagan, Burtolla, Burrabazar, Posta, Jorasanko, Amherst Street and areas of any other police station which may be created in future in Kolkata City.

    Debts Recovery Tribunal Lucknow:- The territorial jusrisdiction of the Hon`ble Tribunal covers Ambedkar Nagar, Aligarh, Agra, Barabanki, Balrampur, Bahraich, Bareilly, Bijnor, Bulandshahr, Baghpat, Faizabad, Ghaziabad, Gonda, Gautam Budh Nagar, Hathras, Hardoi, Jyotiba Phule Nagar, Lucknow, Lakhimpur, Meerut, Moradabad, Muzafffarnagar, Mathura, Pratapgarh, Pilibhit, Rampur, Rae Bareilly, Sharanpur, Shahajahanpur, Sitapur, Shravasti, Sultanpur, Unnao districts of Uttar Pradesh & State of Uttaranchal.

    Debts Recovery Tribunal Madurai:- The territorial jusrisdiction of the Hon`ble Tribunal covers Districts of Madurai, Kanyakumari, Tirunelveli, Tuticorin, Virudhunagar, Sivaganga, Ramnad, Theni, Erode, Salem, Namakkal, Trichy, Karur and Dindigul in the State of Tamil Nadu.

    Debts Recovery Tribunal-1 Mumbai:- The territorial jusrisdiction of the Hon`ble Tribunal covers City Area of A Ward as defined by Mumbai Municipal Coropration bounded as below excluding areas of Nariman Point :- East : Dock area, Ballard Estate, Shahid Bhagat Singh Road, P.Demello Road West :Marine Drive North : Anandilal Poddar Marg, Lokmanya Tilak Marg South : Colaba.

    Debts Recovery Tribunal-2 Mumbai:- The territorial jusrisdiction of the Hon`ble Tribunal covers Nariman Point in A ward bounded as south : Arabian Sea & Nathalal Parekh Marg West : Dorabjee Tata Road North : Madam Cama Road East : Maharshi Karve Road and B ward to G Ward ie; excluding the areas of jurisdiction of Mumbai DRT No.1 and excluding Suburban & extended suburban areas of Greater Bombay.

    Debts Recovery Tribunal-3 Mumbai:- The territorial jusrisdiction of the Hon`ble Tribunal covers Areas of H Ward to T Ward ie; Suburban & extended Suburban areas of Greater Bombay and districts of Thane, Raigad, Ratnagiri and Sindhudurg in Maharashtra state and the state of Goa and any other areas of Mumbai not covered by Mumbai DRT No.1 & Mumbai DRT No.2.

    Debts Recovery Tribunal Nagpur:- The territorial jusrisdiction of the Hon`ble Tribunal covers Nagpur, Bhandara, Gondiya, Amravati, Chandrapur, Yavatmal, Gadchiroli, Akola, Buldhana, Washim & Wardha districts of Marashtra State.

    Debts Recovery Tribunal-1 New Delhi:- The territorial jusrisdiction of the Hon`ble Tribunal covers South Delhi District Hauz Khas, Malviya Nagar, Mehrauli, Defence Colony, Lodhi Colony, Kotla Mubarakpur, Lajpat Nagar, Srinivas Puri, Hazrat Nizamuddin, Greater Kailash, Chitranjan Park, Ambedkar Nagar, Kalkaji, Badarpur, Okhla, any other police station which may be existing or created in future in this area.

    Debts Recovery Tribunal Visakhapatanam:- The territorial jusrisdiction of the Hon`ble Tribunal covers East Godavari, West Godavari, Guntur, Kirshna, Nellore, Praksam, Srikakulam, Vizianagaram & Vishakapatnam districts of Andhra Pradesh.

    Debts Recovery Tribunal Ranchi:- The territorial jusrisdiction of the Hon`ble Tribunal covers State of Jharkhand.
